Indiana Bad Drug Lawsuits & Indiana Defective Medical Device Cases

Indiana Civil Statute of Limitations Laws — Code Provisions (Code § 34-18-7-1)
It is crucial understand the Indiana statute of limitations code that greatly restricts the amount of time the victim has in filing a lawsuit or compensation claim against responsible parties. Filing too late could strip away the victim’s opportunity at taking any legal action.
- Personal Injury / Negligence – 2 Years
- Product Liability – 2 Years
- Wrongful Death – 2 Years ‘from date of death or from date of knowledge of injury by radiation or asbestos.’
- Medical Malpractice – 2 Years ‘from act or omission subject to certain statutory exceptions. Minors under age 6 until age 8.’
