In recent years, pharmaceutical companies and medical device manufacturers have brought products to market to alleviate nearly every ailment there is. For every patient saved by these new products, there is also a trail of victims who have suffered serious injury or premature death by bad drugs and defective medical devices brought to market by companies who are more interested in generating profits than ensuring consumer safety.

State of Minnesota Statute of Limitations

Minnesota Civil Statute of Limitations Laws — Code Provisions (Section 541.05)

It is important for victims understand the Minnesota statute of limitations code which greatly restricts the amount of time they must file a case for compensation against every party responsible for causing their injury. The statutes also include the amount of time families must file a wrongful death lawsuit against pharmaceutical companies, medical device manufacturers, doctors and hospitals that are responsible for the premature loss of a loved one.

Failing to file all the necessary paperwork in the appropriate courthouse in a timely manner — before the expiration of the statute — takes away the legal opportunity the victim has at seeking compensation.

  • Personal Injury / Negligence – 6 Years ‘with Discovery Rule (includes cases of domestic and sexual abuse). However, if injury caused by unsafe condition of real estate, the SOL is two years.’
  • Product Liability – 4 Years
  • Wrongful Death – 3 Years
  • Medical Malpractice – 2 Years
  • Intentional Torts – 2 Years
