Missouri Bad Drug Lawsuits & Missouri Defective Medical Device Cases

If the doctor orders a prescription medication or recommends the implantation of a medical device (joint replacement, vaginal mesh, etc.), the patient expects to feel better and remain safe. However, many patients suffer serious harm from adverse side effects and reactions caused by these products. Unfortunately, many pharmaceutical companies and medical device manufacturers are aware of the defects in their product and choose instead to continue generating profits at the patient’s expense.

Usually, the victims of these products are left with no other option than to file Missouri bad drug lawsuits, medical malpractice cases, and Missouri defective medical device claims for compensation against every party at fault. However, because of the complexities of Missouri tort law, they usually must seek out the advice of a competent attorney to handle every aspect of their case. The information below can assist the victim in determining if they have a valid case and if the case can still be filed in a Missouri court.

State of Missouri Statute of Limitations

Missouri Civil Statute of Limitations Laws — Missouri Code Provisions (Section 516.105.1)

The code provision involving the Missouri statute of limitations greatly restricts the amount of time that every surviving family member or victim of bad drugs, defective medical devices or medical malpractice can file a claim or lawsuit against every party responsible for the harm. If the necessary paperwork is not filed in a timely fashion in the appropriate courthouse in Missouri, the victim and surviving family members most often lose the legal opportunity they have to obtain compensation.
