Missouri Bad Drug Lawsuits & Missouri Defective Medical Device Cases

Missouri Civil Statute of Limitations Laws — Missouri Code Provisions (Section 516.105.1)
The code provision involving the Missouri statute of limitations greatly restricts the amount of time that every surviving family member or victim of bad drugs, defective medical devices or medical malpractice can file a claim or lawsuit against every party responsible for the harm. If the necessary paperwork is not filed in a timely fashion in the appropriate courthouse in Missouri, the victim and surviving family members most often lose the legal opportunity they have to obtain compensation.
- Personal Injury / Negligence – 5 Years
- Product Liability – 2 Years
- Wrongful Death – 3 Years
- Medical Malpractice – 2 Years ‘with Discovery Rule. Infant under 18 has until 20th birthday to bring action. Foreign object, within 2 years of discovery, maximum of 10 years from date of occurrence, or minor’s 20th birthday.’
- Intentional Torts – 2 Years
