Nebraska Civil Statute of Limitations Laws — Code Provisions (Neb. Rev. Stat. Ann. § 25-222)
It is important for every victim’s surviving family member filing a lawsuit for compensation to understand the Nebraska statute of limitations code. This code limits the amount of time a plaintiff can file a claim for compensation against pharmaceutical companies, medical device manufacturers, hospitals, doctors, nurses and other health care providers. Any failure to file the necessary paperwork in the appropriate court house within a timely manner, before the statute of limitations expires, forfeits the victim’s ability to seek financial recompense for their damages.
- Personal Injury / Negligence – 4 Years
- Product Liability – 4 Years
- Wrongful Death – 2 Years
- Medical Malpractice – 2 Years “If the injury is not discovered within the two-year period, then the action must be filed within one year from the date that the injury was, or should have been, discovered, whichever is earlier. In no event, may a medical malpractice action be filed more than 10 years after the act giving rise to the injury occurred.”
