New Hampshire Bad Drug Lawsuits & New Hampshire Defective Medical Device Cases
With the advancements of pharmaceutical medications and technological processes, many new products in the medical industry have reached the market in recent years. These products required the approval of the FDA (Food and Drug Administration) that oversees patient safety when using prescription drugs and medical devices. Unfortunately, many companies often prioritize profits over consumer safety and rush products to market to the benefits of their shareholders. Because of that, patients who have suffered serious adverse effects from these products have been filing New Hampshire bad drug lawsuits, medical malpractice claims, and New Hampshire defective medical device cases to seek the compensation they deserve.
Unfortunately, these cases tend to be highly complex and require a comprehensive understanding of New Hampshire tort law. Because of that, many victims are hiring skilled personal injury attorneys who specialize malpractice and product liability cases. The list below provides access to resources necessary to seek recompense including the New Hampshire statute of limitations, medical resources, legal resources and the availability of legal assistance through competent personal injury attorneys.
State of New Hampshire Statute of Limitations
New Hampshire Civil Statute of Limitations Laws – Code Provisions (Rev. Stat. § 508:4(II))
The New Hampshire statute of limitations code was enacted to enforce the limited amount of time that every victim or surviving family member can file a lawsuit or claim for compensation against any party responsible for their damages. This includes cases involving negligence, personal injury, product liability, medical malpractice and wrongful death.
Any failure to file all the necessary documentation in the appropriate New Hampshire courthouse could strip away the rights of the victim and surviving family members and their ability to obtain the financial recompense they deserve.
Personal Injury / Negligence – 3 Years
Product Liability – 3 Years
Wrongful Death – 3 Years
Medical Malpractice – 2 Years “Actions against health-care providers must be filed within two years of the malpractice. This limitations period applies to minors who are eight and older. A minor under eight has until his or her 10th birthday to file a medical malpractice action. In foreign object cases, suit must be filed within two years of insertion of the foreign object or within two years of discovering the foreign object, whichever is earlier. This rule applies to minors.”
