New Jersey Bad Drug Lawsuits & New Jersey Defective Medical Device Cases

Pharmaceutical companies and medical device manufacturers have the legal responsibility to ensure that every product they bring to market is safe. In addition, it is their responsibility to warn the consumer of any potential serious side effect or dangerous adverse reaction when using the product. Unfortunately, many of these companies focus more on generating profits for the shareholders and less on ensuring the safety of the consumer. Because of that, many victims have no other option than to file New Jersey defective medical device cases, medical malpractice claims, and New Jersey bad drug lawsuits to seek the compensation their family deserves.

However, the complexity of filing a lawsuit against a large corporation, hospital or doctor can be overwhelming. The list below can help victims and surviving family members initiate a lawsuit. The list provides immediate access to the New Jersey statute of limitations, legal resources, medical resources and experienced personal injury attorneys who specialize in these types of cases.

State of New Jersey Statute of Limitations

New Jersey Civil Statute of Limitations Laws — Code Provisions (Section 2A:53-27)

The New Jersey statute of limitations code sets the amount of time any victim or their surviving family member can file a claim for compensation against all parties who are at fault for causing their injuries, damages and losses. If the statute of limitations expires, the plaintiff must forgo their legal opportunity to seek compensation. Because of that, many victims will hire personal injury attorney to determine the merits of their case and make sure that all the necessary paperwork is filed in the appropriate New Jersey courthouse to ensure a successful outcome to the case.

  • Personal Injury / Negligence – 2 Years
  • Product Liability – 2 Years
  • Wrongful Death – 2 Years “with Discovery Rule, provided that normal limitation for personal injury has not run before death. Minor from birth: until age 12. No [statute of limitation] if death caused by murder or manslaughter.”
  • Medical Malpractice – 1 Years
  • Intentional Torts – 2 Years
